Welcome to JIYAR Environmental Technologies Pvt. Ltd. These terms and conditions outline the rules and regulations for the use of our services, hardware, and digital platforms. By engaging our services, signing an AMC, or utilizing our Turnkey Leasing (HaaS) models, you agree to these operational and commercial terms.
JIYAR Environmental Technologies provides precision instrumentation to accurately measure and report your plant's environmental parameters. However, the ultimate legal responsibility for environmental compliance rests solely with the client facility. JIYAR is not liable for any fines, penalties, show-cause notices, plant closures, or legal actions instituted by the CPCB, SPCB, or any governmental body arising from the plant exceeding statutory emission limits.
For clients enrolled in our Turnkey Leasing (HaaS) program:
Our Annual Maintenance Contracts (AMC/CAMC) guarantee rapid breakdown response and routine calibration. However, the following are strictly excluded from standard SLA coverage:
PredictX cloud dashboards and automated CPCB/SPCB portal transmissions rely on the stability of the local network. JIYAR is not liable for data gaps or delayed transmission logs caused by outages in the client’s internal IT network, corporate firewall blocking, or regional telecommunication/GSM failures.
Unless otherwise specified in a formalized contract, all invoices for AMC services, HaaS leasing subscriptions, or hardware procurement are payable within thirty (30) days of the invoice date. Late payments shall incur an interest charge of 1.5% per month on the outstanding balance, or the maximum rate permitted by law. JIYAR reserves the right to suspend field services and cloud dashboard access if accounts become severely delinquent.
During the course of installation, maintenance, or monitoring, JIYAR personnel may be exposed to proprietary manufacturing processes, plant schematics, or trade secrets. JIYAR commits to holding all such client information in strict confidence and will not disclose it to unauthorized third parties. Conversely, the client agrees to maintain the strict confidentiality of JIYAR's pricing structures, proprietary JIYAR Insight™ OS software architecture, and custom panel engineering designs.
To the maximum extent permitted by applicable law, JIYAR Environmental Technologies' total aggregate liability for any claims, losses, or damages arising out of or related to our services, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the client to JIYAR for the specific service or hardware contract giving rise to the claim during the twelve (12) months immediately preceding the event.
In the event of non-payment or breach of contract terms, JIYAR reserves the right to suspend JIYAR Insight™ cloud dashboard access and cease automated server transmissions. Upon termination of a HaaS lease or service contract, JIYAR retains the unhindered right to physically enter the client premises to decommission and recover all leased intellectual and physical assets.
These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these operational terms, maintenance contracts, or equipment leases shall be subject to the exclusive jurisdiction of the courts located in Ranchi, Jharkhand.
